Terms and Conditions for HD Budget Cleaners Pty Ltd
1. Acceptance of Terms
By using our services, including but not limited to placing an order via telephone at 07 3523 3578 / 0468905455 / 0469341399, email at sales@hdbudgetcleaners.com.au, or through our website at www.hdbudgetcleaners.com.au, you agree to be bound by these Terms and Conditions. These Terms and Conditions are subject to change at any time without prior notice, although we will notify you of any amendments by posting them on our website. You are encouraged to review this page regularly to stay informed of any updates.
2. Definitions
In these Terms and Conditions, the following definitions apply:
- Customer or You: Any individual or entity that purchases services from HDBudget Cleaners.
- We, Us, or Our: HDBudget Cleaners, including any authorized contractors.
- Services or Service: Any cleaning services requested by the Customer from HDBudget Cleaners.
- Cleaner: Any personnel employed or contracted by HDBudget Cleaners to perform the cleaning services.
- Property: The location where the Services are to be performed.
- Bond Cleaning Standards: The cleanliness standards required for the Customer to receive their bond back as per the requirements set by their landlord or property manager.
3. General Provisions
These Terms and Conditions apply to all contracts for the provision of Services and take precedence over any prior communication with the Customer. We maintain a zero-tolerance policy towards inappropriate behavior directed at our staff. Any harassment, intimidation, or abusive language will result in the immediate termination of Services without a refund.
4. Pricing
- All quotes provided are estimates based on the information available at the time of booking. Final charges may vary depending on the actual condition of the Property on the service day.
- Additional charges may apply for unforeseen conditions, such as heavily soiled areas or additional rooms not specified during the booking process.
- A detailed list of services included and excluded from the quote can be provided upon request.
5. Payment Terms
- Invoices will be issued after the completion of Services and are to be paid within 14 days of the invoice date.
- Payment can be made via bank transfer or credit card. A late fee of $50 will apply if payment is not received within 14 days, and additional fees may accrue thereafter.
- If payments are overdue for more than 30 days, we reserve the right to escalate the matter to a debt collector, and all associated costs, including any administration charges, will be applied to the Customer
6. Access to Property
- The Customer is responsible for ensuring that access to the Property is available at the scheduled time. Failure to provide access may result in a non-access fee of $110.
- The Customer must ensure that all personal items are removed from the Property prior to the commencement of Services. Any areas that cannot be accessed or are obstructed by personal belongings will void the Bond Cleaning Guarantee for those areas.
7. Cancellations and Refunds
- Cancellations made more than 24 hours prior to the scheduled service will incur no administration fee. Cancellations made within 24 hours of the scheduled service will incur a $150 cancellation fee.
- We reserve the right to cancel or refuse services if the condition of the Property presents a safety hazard to our cleaners or if access cannot be provided as scheduled.
- HDBudget Cleaners reserves the right to cancel any service request at its discretion.
- If you fail to provide sufficient notice or access for the return visit and cleanup, no refunds or compensation will be provided. We kindly ask that you ensure ample time is allocated for the cleaning to be finalized with the real estate.
- No refunds will be issued, and no work guarantee applies if any trade work has been carried out on the property after the cleaning service. The property must remain in the same state.
- We reserve the right to re-schedule or cancel any Service if the property is not as described, either in condition or size.
8. Bond Return Guarantee
- We offer a Bond Return Guarantee that includes a re-clean of any areas deemed unsatisfactory by the Property Manager, provided that the re-clean request is submitted in writing within three calendar days of the initial cleaning and includes photographic evidence of the areas of concern. Additionally, the Guarantee is applicable only to those areas where services have been performed in accordance with our inclusion list, and it does not cover areas that were inaccessible or not cleaned due to safety concerns.
- Our Bond Cleaning Guarantee is exclusively applicable to the specific services you have requested; for example, if you engage us solely for a Bond Clean and not for carpet cleaning, the Guarantee will only cover the Bond Clean, with carpet cleaning being expressly excluded.
- A re-clean will only be considered upon receipt of a written report from the Managing Agent that clearly outlines the issues with the cleaning, accompanied by photographic evidence.
- We require a notice period of 24 to 36 working hours from the date of receipt of the Managing Agent's report to reschedule a re-clean, if necessary. The re-clean will exclusively address the issues specified in the original report provided by the Managing Agent. Following the re-clean, we will warrant the work for a duration of one day. Unless otherwise agreed in writing, if we do not receive communication from the Managing Agent within 24 hours, we will consider the re-clean to have satisfactorily resolved any issues under the Bond Cleaning Guarantee, and the job will be deemed complete in accordance with our Terms and Conditions.
- These Terms and Conditions remain in effect until the commencement and finalization of the service, whether it is a cleaning, re-clean, or the interim period between re-cleans and inspections. All re-cleans are subject to these Terms and Conditions.
- Customers acknowledge that our Bond Return Guarantee is only valid if they contact us within three calendar days following the completion of the service. We do not provide guarantees for natural occurrences over time, including but not limited to settled dust, water marks, and the presence of insects in uninhabited properties. Consequently, we do not guarantee any issues arising from such events, which are excluded from the Bond Return Guarantee.
- The Bond Return Guarantee will be rendered null and void if the property is not maintained in a vacant state following the cleaning. Exceptions to this provision apply only if carpets are cleaned by a qualified carpet cleaner authorized by us or if there is a prior written agreement from us.
- It is imperative that the bond clean is scheduled only after the removal of all furniture, ensuring that the premises are uninhabited and all necessary maintenance or other work has been completed.
- We will not be held liable for any incidents classified as Acts of God, including but not limited to floods, storms, fires, earthquakes, cyclones, or similar events.
- The Bond Return Guarantee does not imply that you will receive the full amount of your bond back. It signifies that we provide a work guarantee solely for the services rendered within the cleaning scope as outlined in our inclusion list. Excluded from this guarantee are items or areas that could not be cleaned due to factors such as the potential for further damage, inaccessibility, safety hazards, or other business-related decisions. Please note that we do not undertake repairs for any areas that are damaged.
9. Refusal to Clean for Safety or Risk Reasons
We reserve the right not to clean an item or area within the Property (at no discount price to the Customer) if the item may pose a possible risk to the cleaner, such as cracked or broken power points, hazardous light fittings, or working at unsafe heights. In such instances, the Customer will be notified, and the Bond Cleaning Guarantee related to that area or item will be void.
It is understood that some items are subject to wear and tear, and some may be unable to be cleaned due to long-term or excessive exposure to grime. In these cases, no warranty will apply.
10. Quote Variations
If during the service, we determine that a variation in the quote is required due to unforeseen circumstances, we will contact you to discuss the changes. Once the variation is agreed upon, you agree to provide full payment for the updated amount after the work has been completed. If you do not agree with the proposed variation, please note that this may void some or all parts of the Bond Cleaning Guarantee.
11. Limitations of Our Guarantee
We can only guarantee the quality of our work. We are not responsible for any pre-existing damage or deterioration in the Property. Our Bond Return Guarantee does not cover items or areas that we are unable to clean due to safety concerns, wear and tear, or excessive grime.
12. Complaints Procedure
All complaints must be made in writing and submitted to complaints@hdbudgetcleaners.com.au within 36 hours of the completion of the service. Please include the details of the complaint, along with supporting evidence such as photos, and a description of the desired resolution. Failure to follow this process may result in the dismissal of the complaint.
13. Liability
We will not be held liable for any incidental or consequential damages arising from the use of our services. Customers are responsible for ensuring that valuables and fragile items are safely secured prior to the commencement of the cleaning service.
14. Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising in connection with these Terms shall be resolved exclusively by the courts within that jurisdiction.
15. Claims
- Under no circumstances will refund claims be considered once the service has been completed and we have vacated the property.
- The Customer must agree to allow a re-clean or an inspection of any work deemed unsatisfactory before arranging a third party to conduct service.
- The Bond Cleaning guarantee applies only to the Bond Cleaning services, not to carpet cleaning or pest control, which will be warranted by the contractor providing these services.
- All care is taken during the service. If any damage beyond ‘wear and tear’ is believed to have occurred, please provide written notice and applicable photos. You agree to waive any right of claim against us for any incidental costs incurred, including but not limited to rent payable or loss of bond monies arising from the service. Claims of damages will require proof that the damage occurred during the service, and responsibility lies with the contractor if fault is accepted.
- If you require your fridge or freezer to be cleaned, you are responsible for emptying and defrosting it in advance. Additional costs may apply. You should inform us of any incidents of accidents, breakage, damage to property, or theft within 24 hours of the service completion.
16. Bond Return Guarantee Specifics
Our Bond Cleaning Guarantee means we will return free of charge to rectify any issues identified by the Managing Agent, provided the re-clean request is made within three calendar days of the initial cleaning and the Property remains vacant. The Guarantee does not cover items or areas not accessible or cleaned due to safety concerns.
We will require 24-36 working hours from the receipt of the report to reschedule a re-clean. All re-cleans are subject to these Terms and Conditions. The Bond Return Guarantee is void if the property does not remain vacant after cleaning, unless carpets are cleaned by an authorized professional.
